DevLaunch Affiliate Program Agreement
Read before applying. Acceptance is recorded when you submit the agreement in your signed-in DevLaunch account.
1. Who this agreement is with
This agreement is between you and HYPERCAT STUDIO, the operator of DevLaunch (we, us). It covers your participation in our affiliate program and your use of our affiliate workspace and promotional resources. Our general Terms of Service and Privacy Policy also apply. Whop is a separate service with its own terms. You must be at least 18 and have authority to accept this agreement for yourself or the business you identify.
2. Application, approval, and account accuracy
Provide accurate contact information, your promotional channels, and an honest description of how you intend to promote our products. DevLaunch automatically approves a complete application after you affirmatively accept the current agreement, unless your participation is restricted or held for review. Dashboard access also requires an existing active affiliate relationship with our business in Whop. We verify that status when you connect and access the workspace. Whop enrollment does not by itself create a DevLaunch login, accept this agreement, or grant paid product access. Use your own accounts and matching verified emails. Keep your information current, protect your login, and do not share access or impersonate another affiliate.
3. Honest recommendations and clear disclosures
Describe products, prices, inclusions, setup requirements, and your experience accurately. Include a clear, prominent statement that you may earn a commission alongside each recommendation or referral link. In video, make the relationship clear in the video as well as the accompanying text; repeat disclosures where needed for viewers to notice them. A disclosure hidden in a profile, terms page, or after a long block of hashtags is not sufficient. Do not invent testimonials, demonstrations, earnings claims, guarantees, scarcity, deadlines, discounts, or results. Use current product details and promptly correct outdated or misleading material.
4. Prohibited promotion and referral abuse
Do not use spam, unsolicited bulk messages, unlawful calls or texts, bought contact lists without a lawful basis to contact them, misleading ads, impersonation, malware, forced redirects, cookie stuffing, fabricated purchases, stolen payment details, or other attempts to manipulate attribution. Do not refer purchases you control or arrange artificial transactions to earn commissions. Do not offer unapproved rebates, coupons, or incentives. Follow the rules of the channels you use and all applicable advertising, privacy, intellectual-property, and consumer-protection requirements.
5. Brand, artwork, and your own website
While approved and in good standing, you receive a limited, non-exclusive, revocable permission to use the promotional materials we provide solely to promote the relevant DevLaunch offers under this agreement. You may customize provided HTML website packages for your own campaign while preserving accurate claims, attribution, and disclosures. You may not sell or sublicense our promotional assets, redistribute paid products, or present yourself as the official DevLaunch site, employee, or support team. Ownership of our brand and materials stays with us or the relevant rights holder. Do not register domains or social identities that impersonate us. Obtain written approval before bidding on DevLaunch, HYPERCAT, Hyperflow, or our product brand names in paid search. Whop’s separate brand restrictions also apply.
6. Commissions and payment responsibilities
Whop administers tracked purchases, applicable affiliate offers, commission reporting, and payouts under its terms. Review the rate and payment conditions shown for your account and product at the time of purchase. A displayed price, a link click, or a dashboard estimate is not a promise of payment. Refunds, disputes, reversals, fraudulent transactions, and attribution issues may affect eligibility under the applicable Whop terms. We do not guarantee earnings or a particular tracking result. DevLaunch approval is not a promise of a fixed commission rate. Special bonuses require written terms identifying the eligible affiliate, dates, products, and calculation; a general announcement does not override those terms.
7. Upfront requests, costs, and taxes
For a purchase arranged by email, ask the buyer to include your referral link so the team can review attribution before payment. An email introduction does not automatically create an attributed Whop sale or guarantee a commission. You are responsible for your own campaign costs, hosting, software, and applicable taxes; do not incur costs on our behalf without a separate written agreement. Complete any payout or tax verification directly through Whop or the authorized provider. Do not send bank information or tax identifiers through the DevLaunch application form.
8. Independent relationship and customer support
You act independently. This agreement does not make you an employee, agent, partner, joint venturer, or authorized representative of DevLaunch. You cannot bind us, collect money on our behalf, change product terms, promise refunds, or provide commitments about features, delivery, support, or results beyond the current written offer. Direct purchase, account, and product-support questions to hello@devlaunchlearn.com or the appropriate Whop support channel. Paid services between you and a customer must be clearly separate from a DevLaunch purchase.
9. Review, correction, and records
We may review your application and promotional channels, ask for examples of your marketing, request corrections or removal, and keep records of reviews and enforcement. Cooperate with reasonable requests and promptly stop publishing content identified as misleading, infringing, or otherwise in breach. We record the agreement version and text, your authenticated account, verified email, submitted name and channel information, acceptance time, and program decisions to administer the relationship, prevent abuse, and resolve disputes as described in our Privacy Policy. Do not submit customer records, passwords, or confidential third-party information in applications or support materials.
10. Suspension, ending participation, and prior transactions
We may decline an application, suspend or end DevLaunch approval, revoke use of our promotional materials, or request Whop restrictions for breach, suspected fraud, security concerns, legal requirements, or a decision to change or end the program. We may act immediately where needed to protect customers or the program and will provide a reason where reasonably possible. You may stop participating and contact us to close your program access. When permission ends, stop new promotion and remove our brand materials and offers from channels you control when requested. A DevLaunch portal suspension and Whop account restrictions are separate actions. Prior transactions and earned amounts remain subject to applicable law and Whop’s terms; this agreement does not authorize arbitrary retroactive forfeiture of valid commissions. 11. Responsibility, limits, and changes
You are responsible for the content and methods you use, for rights to material you add, and for correcting your own misleading or unauthorized statements. Our general Terms of Service govern applicable limitations of liability and governing law, subject to rights that cannot lawfully be excluded. Nothing here excludes liability or remedies that applicable law does not allow us to exclude. We may update this program agreement and require affirmative acceptance of a new version before continued dashboard use. Each acceptance is recorded separately. Material changes apply prospectively, subject to applicable law and the terms governing prior transactions.
